New Jersey Restraining Orders

In the state of New Jersey, someone may qualify for a domestic violence restraining order if his or her relationship with the accused falls into one of the following categories:

If you fit the above qualifications, you may be able to file for a temporary restraining order and then seek a final restraining order. At the hearing, the court will decide whether a final restraining order is needed and may enter other items of relief.

Temporary Restraining Order

A Temporary Restraining Order (TRO) provides protection between the initial complaint and the court hearing. When a complaint is filed, a temporary restraining order may be in effect for about 10 days. Both parties will receive a copy of the TRO, and then use the time between the filing and the hearing to gather evidence, documentation, and prepare statements.

Final Restraining Order

Following a hearing in which both parties may produce evidence and share their side of the story, a Final Restraining Order (FRO) may be ordered. A Final Restraining Order has no definitive end date and is permanent unless or until one of the parties files a motion in court to modify or end it and that request is granted.
